California judge pauses voter probes in 9 states over unreliable data, then delays ruling for appeal

A federal judge in California has ordered a temporary stop to federal investigations into suspected noncitizen voter registration across nine states. She ruled that officials relied on unreliable data and risked frightening eligible voters.

US District Judge Araceli Martínez-Olguín, who is based in Oakland, issued an order blocking the federal investigations until polls close on Election Day, 3 November. However, she put her own ruling on hold until Friday, 23 October, to give federal lawyers time to file an emergency appeal. The decision affects federal investigations in nine states: California, Connecticut, Georgia, Missouri, Nevada, New York, Pennsylvania, Washington and Wisconsin.

Flawed data driving investigations

The court's action followed growing concerns about how the federal investigation was being carried out. The programme, officially called the "Unlawful Voter Initiative," became public after Democratic Senate Minority Leader Chuck Schumer of New York and Democratic Senator Alex Padilla of California released a whistleblower report describing the scale of the operation. In her ruling, Judge Martínez-Olguín raised serious concerns about how federal agents chose people for investigation.

According to reports by the Associated Press, The Washington Post and The Guardian, federal agents used databases with many errors and missing information to identify people suspected of being noncitizens who were registered to vote. The court noted that investigators had as little as 12 minutes per person to check whether someone was legally allowed to vote before starting field inquiries. Judge Martínez-Olguín found that such quick checks created a serious risk of wrongly targeting eligible U.S.

citizens. These could include people who had recently become citizens or whose state records had not yet been updated in federal systems.

Protecting voter participation

A group of civic organisations and labor unions brought the case against the federal government. The groups included the California Nurses Association, National Nurses United, the Voto Latino Foundation, the City and County of San Francisco, and Santa Clara County. The plaintiffs argued that aggressive field interviews and checks based on unverified information created fear among voters.

They said these actions could discourage eligible citizens and community volunteers from taking part in regular voter registration activities.

According to Democracy Docket and The Guardian, Judge Martínez-Olguín agreed with the civic groups. She found that the Department of Homeland Security's investigation methods amounted to ongoing intimidation and threatened serious, lasting harm to eligible voters ahead of the upcoming elections.

The judge made clear that her order does not allow noncitizens to register or vote in federal elections. Both remain illegal under federal law. Instead, the order limits how the government carries out its investigations to protect eligible voters from being harassed because of incorrect records.

Federal defence and administrative context

The federal government defended its actions in court. Officials argued that these investigations were needed to protect election integrity and enforce federal immigration laws.

Representatives of the Department of Homeland Security said that investigating possible unlawful voter registration was within the executive branch's legal powers. Administration officials have claimed that noncitizen voting poses a widespread threat to elections.

However, research and earlier federal reviews show that noncitizen voting is extremely rare. Such voting has never occurred on a scale large enough to change an election result.

To give government lawyers time to ask the Ninth U.S. Circuit Court of Appeals for an emergency stay, Judge Martínez-Olguín temporarily paused the enforcement of her order through Friday, 23 October.

Broader legal implications

The federal court's order is one of the most important recent limits on government programmes designed to check voter eligibility. By requiring officials to verify their data carefully, the court established that federal authorities cannot ignore established state verification systems or carry out broad door-to-door investigations based on unconfirmed lists.

Voting rights advocates welcomed the ruling.

They stressed that federal checks must respect the constitutional rights of eligible voters. Legal experts expect the case to move quickly through the appeals courts as early voting deadlines approach in several affected states. The temporary pause allowed existing legal standards to remain in place while the appeals court considered whether to uphold the lower court's limits on federal field investigations.
